Terms of Use

1. Service Description

ForexTracker is a SaaS trading journal and analytics platform accessible via browser at app.forextracker.com.br. The service allows users to log trading sessions, calculate performance metrics (Win Rate, Profit Factor, Payoff R:R, Expectancy) and monitor accounts across prop firms and brokers.

Important disclaimer: ForexTracker is a tracking and analytics tool. It does not constitute financial advice, investment consulting or trade recommendations. All trading decisions are the sole responsibility of the user.

2. Eligibility

• You must be at least 18 years old to create an account
• You must have the legal capacity to enter into contracts
• One account per person — shared accounts are not permitted on the free plan

3. Account Registration

• You are responsible for keeping your password confidential
• Notify us immediately of any unauthorised use of your account
• Creating fake accounts, using third-party data or circumventing plan restrictions is prohibited
• We reserve the right to terminate accounts that violate these Terms

4. Plans and Payments

4.1 Free Plan

Available at no cost with no expiry date. Limited to 1 active account and 60 days of history. No credit card required.

4.2 Monthly Plan

Recurring monthly charge of USD $9.90/month. The subscription renews automatically on the same day each month. You may cancel at any time; cancellation takes effect at the end of the current billing period.

4.3 Yearly Plan

Single annual charge of USD $99.90/year. You may cancel at any time without penalty; however, no proportional refund is provided for the unused portion, unless required by applicable law.

4.4 Refunds

You may request a full refund within 7 calendar days of your first purchase. After this period no proportional refund is available for the yearly plan.

4.5 Price changes

We will give at least 30 days' notice of any price changes via your registered e-mail address. Continued use after the new price takes effect constitutes acceptance.

5. Acceptable Use

The following are prohibited:

• Reverse-engineering, decompiling or copying any part of the platform
• Using the platform for unlawful purposes or to violate third-party rights
• Attempting to access other users' accounts or data
• Intentionally overloading servers (DDoS attacks, aggressive scraping)
• Reselling or sub-licensing access to the platform without express authorisation

6. Intellectual Property

All platform content (code, design, brand, proprietary metrics, text) is owned by ForexTracker and protected by intellectual property laws. Users retain ownership of the trading data they enter into the platform.

7. Service Availability

We aim for 99.5% monthly uptime but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance. We are not liable for losses resulting from service unavailability.

8. Limitation of Liability

ForexTracker is not liable for:

• Financial losses resulting from trading decisions based on platform data
• Data entry errors made by the user
• Temporary service unavailability due to force majeure
• Indirect, incidental or consequential damages

Our total liability is limited to the amount paid by the user in the preceding 3 months.

9. Termination

You may close your account at any time via the platform dashboard or by e-mail. We may suspend or terminate accounts that violate these Terms, with prior notice except in cases of serious violation or fraud.

After closure, your data is retained for up to 90 days before permanent deletion, except where required by law.

10. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated at least 15 days in advance by e-mail. Continued use after the effective date constitutes acceptance of the new terms.

11. Governing Law

These Terms are governed by the laws of Brazil. The courts of São Paulo/SP shall have exclusive jurisdiction to resolve any disputes.
